Terms & Conditions

All correspondence(s) in respect of Tours / Travel Services and bookings should be addressed to M/s. Vaikunth Holidays Private Limited. On confirmation of booking your contract is with M/s Vaikunth Holidays Private Limited. A contract exists between us when we confirm your tour/travel services and have received the deposit amount from your end.

Rates mentioned above are valid for Indian nationals only until and unless specified along with quotation.

All the confirmation depend on Airfare and Hotel confirmation are availability at the time of Booking.

The quotations are given without holding any confirmed reservations either in the airlines/transport or in the hotels. Once the quotation is accepted by the guest and advance amount is deposited either in Cheque / cash to process the reservation, the booking is processed at our end. In case we are unable to provide the services then the deposited amount shall be refunded to the guest. For the packages which are booked under our Airline Group Packages the airline tickets might be delivered 2 days before the departure of the group.

MODE OF PAYMENT

All payments are to be made in name of M/s Vaikunth Holidays Private limited. There is no contract between vaikunth holidays Private limited. and the client until the company has received initial deposit amount of specified tour package. The amount paid at the time of booking, is non-refundable. We do not accept any form of cheques. The bookings will be processed only after 25% of the total amount has been paid. The full amount must be paid twenty days before the tour/stay starts. We will send a reminder of full payment 25 days before the tour/stay starts. Failure to deliver complete payment will result in cancellation of the arrangement. For instant bookings or on-the-spot booking, 100% payment is required before bookings are processed.

• By Cash / Cheque / Demand Draft/ OR code.
• By Electronic money transfer (RTGS & NEFT)
• By Online Payment Payu money.
• By Wire transfer / Telex Transfer (for International clients/ agents)

If payment is by cheque, payment should be made at least 01 week before the delivery of documents.
The cost of outbound package tour is payable in convertible foreign exchange (subject to RBI/GOI regulation).

Note:

• All payments should be free and clear of any withholding tax and deduction.
• Bank charges, if any, for remittance (by remitting bank or by intermediary bank) would be strictly borne by payer.
• In case of payment though QR code – if same is done using credit/ debit card then the applicable bank charges are to be borne by payer.
• Payments by payment gateway will attract 3% gateway service charge on each and every transactions.

Special Note:

Please note that Vaikunth Holidays Private Limited employee or agent will not ask for your Net Banking login, Password, OTP etc. Nor will they ask you to transfer funds to a personal account or to install third party apps like Any Desk, Team Viewer etc. Please do not act on such request.

LIABILITY

The Company is acting as booking agent for the overseas tour operator / travel component supplier and is travel agent only. The information given in the brochure is as accurate as the Company can make it. The Company’s brochure descriptions are of amenities normally available. However, circumstances can change due to events beyond the control of the Company. Major roadwork, etc., may necessitate route changes. Where the Company knows of these sufficiently in advance, the Company will notify the Tourist/Group. Route changes could also be necessitated due to natural calamities. The Company does not control or operate any Airline, neither do the Company owns or controls any shipping company, coach or coach company, Hotel, transport and other facility or service ingredients, travel component in tour package/ tour component availed by the Tourist/Group. Since the Company only selects and co-ordinates travel component, the Company shall not be liable for any injury, death, loss, deficiency in service or damage, if any, caused by any act or omission of the management or employees or any independent contractor of any airlines, shipping company etc.

Policy Regarding Cancellation / NO SHOW / EARLY DEPARTURE :

The refund will be in the same currency used in the payment and at no interest. The company does not assume responsibility for the difference the local currency value due to fluctuation of exchange rates. Processing of cancellation must be done by formally writing to the Company. The request will be acted on in a working day except Sat/Sun and national holidays.

In case of cancellation of tour/travel services due to any avoidable/unavoidable reason/s we must be informed in writing. Cancellation charges would be effective from the date we receive letter in writing and cancellation charges would be as follows : Cancellation timelines and refund

• 60 days & prior to arrival – 80% amount will be refunded of total package cost
• 59 days to 40 days prior to arrival – 50% amount will be refunded of total package cost
• 39 days to 25 days prior to arrival – 25% amount will be refunded of total package cost.
• 24 day to 15 days prior to arrival – 15% amount will be refunded of total package cost
• 14 days & less, prior to arrival or no show – NO REFUND.

Note:-

1. Irrespective of above mentioned cancellation slabs, in case of cancellation of tour / travel services (due to whatsoever reason) by yourself (by client) after the booking is made with us – a minimum 10% service charge would be applicable on total cost of the tour package.

2. Irrespective of above mentioned cancellation slabs, in case of cancellation of tour / travel services (due to whatsoever reason) by us (by company) after the booking is made by us – Following two options are available:

• Client would be provided with Credit Note for the booking amount paid and same can be used in the future (except season date) by the client for themselves or any of their family members, friends, or anyone else as recommended by them.
• In case the client wants the refund – then a minimum 10% service charge would be applicable on the total cost of the tour package and remaining amount (after deducting this 10% service charge) would be refunded.

In above both the situation – the cancellation charges, as applicable for cancellation of services related to tickets/ hotel bookings/ travel services/ Guide services would also be recovered from the client.

3. In case you cancel your trip after commencement the refund would be restricted to a limited amount that would depend on the amount that we would be able to recover from the hoteliers, airlines, transporter and other suppliers we patronize. For unused hotel accommodation, flight tickets, transportation, missed meals and any other services etc. we do not bear any responsibility to refund.

4. In case of special train journey (like Palace on Wheels, Deccan Odyssey, Golden Chariot & Maharajas Express) – a separate cancellation policy is applicable (which would be advised as and when required). Cancellation charges for Star Cruises booking shall apply as per star cruises cancellation rules. Cancellation charges for Hotel booking shall apply as per Hotel / Supplier cancellation rules. Cancellation charges for Flight bookings shall apply as per Airline cancellation rules.

5. Please note that if booking for following period is/are cancelled, due to whatsoever reason, no refund would be made for said cancellation.

• Festival Period Bookings (Festivals like – Diwali, Dussehra, Holi, Pushkar fair etc).
• High Peak Season bookings (from 20th Dec to 15th Jan).
• 39 days to 25 days prior to arrival – 25% amount will be refunded of total package cost.
• Long Weekends Bookings.
• Cancellation amount is calculated as per total booking amount and not as per advance deposited

All services provided and assured by the Company are subject to full realization of payment prior to departure. If payment to the Company is made by cheque, the Package/ tour component will be delivered only after realization of cheque.

The Company has right at any time and for any reason:

• To cancel a tour package/tour component prior to the date of departure and if it does so, its liability shall be limited to refunding all the money paid by the Tourist, towards the tour package / tour component.
• To amend, alter, vary or withdraw any tour, holiday, excursion or facility, it has advertised or published, or to substitute a hotel of similar class if it is deemed advisable or necessary. In either case the Company shall not be liable for any damages, additional expenses or consequential loss suffered by the Tourist/Group.
• No person, other than the Company, in writing has authority to vary, add, amplify or waive off any description, representation, terms and conditions set forth herein or in brochure of the Company, or other terms & conditions regarding tour booked by the Tourist with the Company.

Refund

In regard to refund of unused / unutilized services (which are paid for and cancelled in advance) the refund amount would be worked out on the basis of cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take 2 - 4 weeks due to banking procedures. If the refund is made to the credit card account OR to Bank account, the bank charges would be debited from the refund amount.

AMENDMENT POLICY (PREPONE & POSTPONE)

In case client wishes to prepone /postpone his or her travel dates, we request you to kindly reach us 15 days prior to journey date via mail.

However postponing & preponing will attract additional charges.

Also note that few service providers (Hoteliers, Transporter etc.) may apply postpone/prepone charges even after meeting above requirement. In such cases postpone/prepone charges will deducted from the advance amount deposited.

In all prepone or postpone scenarios, the services and the costing will be subject to availability of Hotel/Volvo and season/off season time.

We do not accept any change in plan within 10 days of travel date.

The validity to utilize your Advance payment in prepone/postpone scenarios is 2 Year from the date of advance payment.

The advance payment and the invoice Number allotted to you, are transferable i.e. you can pass on your booking to any of your friends/ relatives. (Please Note : In order to transfer your booking you must meet the above terms and conditions first)

Company has a right to reschedule the site seeing days to ensure smooth execution of tours.

Any amendment requested during the tour, will be treated as a fresh booking and additional cost will be charged other than earlier allocated tour cost.

Mandatory Identification Document:

It is Mandatory for all guests (Foreign Nationals, NRI’s and Indian Nationals) to provide Photo ID at the time of booking confirmation. Documents as per details given below are applicable for different categories :

• For foreign nationals – copy of Passport + Visa is mandatory.
• For Non Resident Indians clients (NRI client) – copy of passport.
• For Overseas Indian clients holding OCI / PIO card – copy of passport and copy of OCI/PIO card is mandatory.
• For domestic clients – copy of Driving License / Voter ID Card / passport is mandatory.

Extra Usage of Vehicle:

Please note that the cost of extra usage of vehicle (cars / coaches with the driver) is not included in the services and hence extra usage of Vehicle after transfer or after sightseeing is not allowed

Arrival and Departure Policy:

Check-In Timings: 1200 - 1400 Hours

Early arrival is subject to availability with extra payment. For guaranteed early check-in, reservation needs to be made starting from the previous night.

Check-Out Timings: 10:00 – 12:00 Hours

Late check-outs are available on request and subject to availability with extra Payment.

STAR CLASSIFICATION OF HOTELS

Star classification of Hotels as 5 star, 4 star and so on is provided to the Company by the supplier of the hotel travel component and the Company endeavour to validate and authenticate this information in utter good faith. The Company cannot be held liable for wrong and inaccurate information provided to the Company. Descriptions, photographs, sketches and list of amenities/facilities are also provided and this information is obtained from the supplier of the hotel travel component.

BAGGAGE ALLOWANCE

Generally one suitcase not exceeding 20 kgs for international Flights and 15 kg for Domestic Flights. and one piece of cabin baggage not exceeding 7 kgs is permitted. But, it is always advisable to check with the specific Airlines/Overseas Tour Operator/Transporter. Allowance may vary from transporter to transporter. As is the common practice, one piece of luggage is to be with linear dimensions (Length + Height + Width) not exceeding 45 inches. The Transporter may charge extra amount for the excess baggage. Against loss or late delivery of baggage payment for the same is subject to conditions laid down by the airline/overseas tour operator/hotel. The Company will not be liable to the passenger for any case of late delivery or loss of baggage weather caused by any airlines, tour operator or hotel or by anyone else.

MEALS

Number of meals including breakfast are always corresponding to the number of nights booked by the Tourist in the hotel. Hotels do not provide breakfast on the day of arrival. The Company reserves the right to change the meal arrangement if circumstances make it necessary to do so. The meals are pre-set and choice of menu is not available.

TRANSFERS

Packages: Wherever transportation is provided on basis of Seat in Coach (SIC) same is on sharing basis.

Sightseeing Tours: Transportation is provided on the basis of Seat in Coach (SIC) same is on sharing basis or Private vehicle basis depending upon the tour/tour option booked.

Airport Transfer: Transportation is provided on the basis of Seat in Coach (SIC) same is on sharing basis or Private vehicle basis depending upon the transfer/transfer option booked.

CURRENCY

The Company suggests the Tourist/Group to carry holiday spending money partly in currency, partly in traveller cheques. It is advisable to arrange the same at least a week before departure. Traveller cheques are safest way to carry money as they are easily cashed for a small service charge and can be replaced, if they are stolen or lost. The Company will not be responsible for any loss of exchange / Currency.

HOTELS TERMS

We have mentioned the names of the Hotels for each tour, we reserve the right to change the same due to unavoidable circumstances. In that case we may provide alternative, similar accommodation for which we are not liable to pay any refund. We will not be responsible or liable in case of loss of property or life at the Hotel. Similarly any damages caused to the hotel rooms during your stay, shall be payable by the Clients and the Company will not be liable for the same.

The hotel confirmed will be as per the brochure or an alternate hotel of similar category.

It is mandatory to carry a Government recognised photo identity card (Passport / Driving Licence / Voter ID card)

Extra Charge! child Above 5 years To 11 years treated as child with bed/mattress

The primary guest checking in to the hotel must be at least 18 years of age. Children accompanying adults must be between 1-15 years.

The inclusion of extra bed with a booking is facilitated with a folding cot or a mattress as an extra bed.

Early check-in or late check-out is subject to availability and may be chargeable by the hotel. The standard check-in time is 12:00 noon and the standard check-out time is 10AM. After booking you will be sent an email confirmation with hotel phone number. You can contact the hotel directly for early check-in or late check-out.

The amount paid for the room does not include charges for optional services and facilities (such as room service, mini bar, snacks or telephone calls). These will be charged at the time of check-out.

The hotel reserves the right of admission. Accommodation can be denied to guests posing as a couple if suitable proof of identification is not presented at check-in. vaikunth holidays will not be responsible for any check-in denied by the hotel due to the aforesaid reason.

The hotel reserves the right of admission for local residents. Accommodation can be denied to guests residing in the same city. Vaikunth holidays will not be responsible for any check-in denied by the hotel due to the aforesaid reason.

Some hotels Pets are not allowed.

Meals menu

The meal menu are pre-set menus provided for breakfast/lunch/dinner on the tour as mentioned under each Tour itinerary as printed in our brochure. We cannot process a special meal nor do we guarantee the special diet to the customer. We however reserve the right to change the meal arrangement if circumstances make it necessary to do so. In the event that a tour participant wakes up late and misses the breakfast offered to him and in the event that the tour participant is out on his own and reaches late and misses lunch/ dinner, then no claim can be made for the meal which he has missed and not utilized

Special Note for Helicopter Journeys :-

1. Helicopter Tickets & Fare are subject to availability & can change at any moment.

2. While Vaikunth Holidays Private limited takes utmost care to make you fly by Helicopter but due to sudden weather conditions / VIP Movement / unavoidable situations at the last moment – it sometimes becomes unavailable. IHPL will make every possible attempt to arrange for alternate Helicopter journey on same day or on alternate dates depending upon the availability of Helicopter at that time.

3. No ticket would be carried forward to next day.

4. No accommodation, meal or cost of transport would be paid or reimbursed or compensated due to cancellation of Helicopter.

5. In case of Journey/ Yatra by Helicopter (Like Chardham Yatra/ Teen Dham Yatra/ Do Dham Yatra/ Ek Dham Yatra/ Vaishno Devi Yatra/ Amarnath Yatra) – a separate cancellation policy will be applicable and same would be advised on case to case basis.

Our liabilities & limitations:

Please note that after the finalization of the tour/service cost, if there are any hikes in entrance fees of monuments/museums, taxes, fuel cost or guide charges by the Govt. of India, the same would be charged as extra.

Vaikunth Holidays Private Limited rates are based on the prevailing rates as negotiated by us with the hotels, airlines etc. Hotels and Airlines retain the right to modify the rates without notice. In case of such change – the rates quoted by us before modification can be changed by us according to the modifications by hotels or airlines.

Vaikunth Holidays Private Limited and its associates acts only in the capacity of an agent for the hotels, airlines, transporters, railways & the contractors providing other services & all exchange orders, receipts, contracts & tickets issued by us – are issued subject to terms & conditions under which these services are provided by them. The tickets, coupons or passage contract in use by carrier / hotel or other contractors rendering services shall constitute the sole contract between the Clients and such contractor.

Vaikunth Holidays Private Limited itineraries are sample itineraries, intended to give you a general idea of the likely trip schedule. Numerous factors such as weather, road conditions, the physical ability of the participants etc. may dictate itinerary changes either before the tour or while on the trail. Vaikunth Holidays Private Limited. reserves the right to amend any aspect of the itinerary including transportation and accommodation without notice in the interest of the trip, participants’ safety, comfort and general well being without making any rebate, allowance or refund and extra cost, if any, would be payable by the client.

Vaikunth Holidays Private Limited shall not be responsible for any delay or change in programme or expenses incurred or special / consequential loss, injury and damage – directly or indirectly – due to natural hazards, flight cancellations, accident, breakdown of machinery or equipment’s, breakdown of transport, weather, sickness, landslides, political closures, acts of God, perils incident to the sea, floods, fire, acts of Government or any other authorities, wars, civil disturbances, riots, theft, pilferage, epidemics, quarantines, medical or custom department regulations, defaults, or any other causes beyond our control or any untoward incidents or any such causes whatsoever including any liability or extra expenses sustained by the Clients. Further, the Clients shall be liable for the liability or extra expenses incurred by him / her as a result of the forgoing causes.

Vaikunth Holidays Private Limited shall not be responsible and shall not accept any liability towards the Clients or his/her legal representative for any loss of property or damages resulting from death or injuries including loss of services which the Clients may sustain on account of act, negligence or default by any transportation Company, hotel agents or any other body of persons, its agents or service providers providing such services or facilities or arising out of or while engaged in any tour, means of transportation or other services, whether due to ownership, maintenance , use, operation or control of any automobile, bicycle, boat, motor, or other vehicle in common carrier or otherwise and whether due to its or there negligence or otherwise or regardless of how caused. Clients using sporting equipment, bicycles, sailing boats, scuba diving gear, hired or supplied by hotels or rental bodies shall do so at their own risk.

Vaikunth Holidays Private Limited do not have any insurance policy covering the expenses for accident, sickness, loss due to theft, or any other reasons. Visitors are advised to seek such insurance arrangements in their home country. All baggage & personal property/s at all times are at the client’s risk.

Vaikunth Holidays Private Limited reserves the right to cancel any services in case it deems that the tour, trip or passage is impracticable for any reason or should circumstances warrant such action, upon refunding the value thereof and the Client shall not have any other or further claim against the company by any reason thereof.

Vaikunth Holidays Private Limited reserves the right to refuse to carry out its contract with any person whom it may consider to be undesirable in its absolute discretion and it shall not be required to show any reason for doing so.

Force Majeure:

Vaikunth Holidays Private Limited. (company) and any of its parents, subsidiaries, affiliates, officers, directors, employees, agents or suppliers and their respective successors, heirs and permitted assigns shall not be responsible for, or be deemed to be in default on account of any failure to perform or due to delay in performance of any of its obligations hereunder, in whole or in part, if such performance is rendered impracticable by the occurrence of acts of war, whether declared or undeclared, sabotage, embargo, acts of terrorism, riot or other civil commotion, failure in transportation, act of any government or any court or administrative agency thereof, acts of God, fire, explosion, flood, earthquake, strike, act of government or other catastrophes, pandemic, epidemics, outbreak of disease or quarantine restrictions, or other cause(s) beyond the reasonable control of Vaikunth Holidays Private Limited. (“Force Majeure”). Vaikunth Holidays Private Limited (company) and client (you)– both shall use their best efforts to avoid, overcome and offset the effects of any cause or potential cause of an event of Force Majeure. Upon cessation of the cause of the Force Majeure, the Terms and conditions of use given hereunder, shall again become fully operative. However, a Force Majeure event will not relieve Vaikunth Holidays Private Limited. (company) and client (you) of the obligations accrued prior to the occurrence of the Force Majeure.

Jurisdiction Clause :

All the disputes arising out of this agreement or any other subsequent agreement would be subject to Himachal Pradesh Courts only.

Special Note:

• Terms & Conditions for Andaman & Nicobar island, Lakshadweep island, inbound and outbound tour will be separate and same will be advised on case to case basis.
• Terms & conditions for Group booking will be separate and same will be advised on case to case basis.
• Terms & conditions for Yatra’s by Helicopter (Chardham Yatra/ Teen Dham Yatra/ Do Dham Yatra/ Ek Dham Yatra/ Vaishno Devi Yatra/ Amarnath Yatra) and any other tour by Helicopter will be separate and same will be advised on case to case basis.
• Terms & conditions for Tourist/ Luxury Trains (Palace on Wheels/ Deccan Odyssey/ Maharajas Express/ Golden Chariot) and any other Tourist / Luxury trains will be separate and same will be advised on case to case basis.

NOTE OF CAUTION BEFORE BOOKING OF PACKAGE/TRAVEL TOUR COMPONENT

Travel tour packages/travel tour components that you are intent to book from us are of such nature where one has to undertake considerable amount of walking and physical activity to enjoy them. All tours involve long hours of travelling and some tour components may include theme park activities such as speed boat rides, balloon rides and other adventure sports which are suitable only for medically/physically fit persons. We therefore, forewarn heart patients, pregnant women, senior citizens, persons those requiring special care, patients of respiratory disorder, persons suffering from arthritis, blood pressure and diabetes, not to undertake tour. There will be no medical help that can be provided during such tours. It is therefore advised not to venture if any person requires special medical attention during the tour. There is no luggage assistance and it is expected every tourist to manage his own luggage. Some of the tourist products are without elevators/escalators and one may has to use stairs.

Inspite of the above mentioned warning tourist who undertakes tour at his own volition and risk, Vaikunth Holidays Private Limited will not be responsible for any medical complication that may arise during the tour. Not only this, one has to be medically fit and energetic to undertake tour packages. You must therefore satisfy yourself by undergoing medical check-up and obtain medical fitness certificate from your registered medical practitioner.

Standard Booking Procedure (in case of Offline Bookings)

If you are booking within 10 days of date of travel, You will need to make payment of 100% of the tour package cost/ tour components costs at time of booking process is undertaken. Any amendment or cancellation made by traveller would be chargeable as per cancellation policy. If you are booking within 10 – 20 days of date of travel, You will need to make payment of 75% of the tour package cost / tour components costs at the time of booking process is undertaken. Any amendment or cancellation made by traveller would be chargeable as per cancellation policy. Balance payment will be required to be paid at the time of confirmation of booking. If you are booking within more than 20 days of date of travel, You will need to make payment of 50% the tour package cost / tour components costs at the time of booking process is undertaken. Any amendment or cancellation made by traveller would be chargeable as per cancellation policy. Balance payment will be required to be paid at the time of confirmation of booking. If your booking is having tour components which needs guaranteed booking as per stipulated condition, You will need to make payment of 100% of the tour package cost/ tour components costs at time of booking process is undertaken. No cancellation will be allowed once booking is made even if by some reason short payment has been made. The tourist will have to make entire payment whether he or she travels or not.

FOG ALERT

The Company will not be liable to any passenger for refund, compensation or claim for shortening of tour in relation to tour shown in itinerary or any cancellation, route change or postponement or delay of any airlines due to any reason whatsoever including fog or bad weather and the tickets/package are issued subject to the conditions herein.

Guest’s acceptance and/or signature on the booking form shall mean complete acceptance of the ‘Terms and Conditions’ contained herein by the guest(s). In case of one person is acting in behalf of the other members of the Group signing the ‘I ACCEPT’, it shall be deemed that the others have duly authorized the concerned signing person. The signing person has to write down the names of the members under his name.
